The regular meeting of the County Commissioners was held today, all members present.  Stohler presiding.

 

The meeting opened with the Pledge to the Flag.

 

The Commissioners approved the minutes the previous meeting.

 

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report.

The Commissioners moved to accept the Treasurer’s report with expenditures for

$1,810,620.55.

 

The Commissioners adopted the Clean Indoor Air Policy in accordance with the Pennsylvania Clean Indoor Air Act that was signed into law by Governor Edward G. Rendell on June 13, 2008 as follows:  

 

The purpose of this policy is to protect the public health, the comfort of all persons and the environment by prohibiting smoking in public places and workplaces.  

 

The Lebanon County Board of Commissioners is dedicated to providing a healthful, comfortable and productive work environment for our employees, as well as a pleasant atmosphere for the public.  

 

It is the policy of the Board that smoking is prohibited inside all County owned or leased buildings and facilities; this includes all offices, hallways, waiting rooms, restrooms, elevators, meeting rooms, stairwells, county vehicles and all indoor community areas.  This policy applies to all elected officials, employees, clients, contractors and visitors. 

 

The burning of incense, potpourri or candles is also strictly prohibited in the areas identified above.

 

Out of respect for employees and visitors, the smoke-free area is further designated as all areas within twenty (20) feet of any public entrance to a County operated building or enclosed facility.

 

Smoking is permitted in designated outside areas only.

The Commissioners approved and signed the Commonwealth of Pennsylvania, State Civil Service Commission, the Delegation of Signatory Authority.  The agencies includes are the Mental Health/Mental Retardation Program, Children & Youth Services and Drug and Alcohol Program.  Signatory Authority is delegated to the County Director of Human Resources, Mental Health/Mental Retardation Program Administrator, Children & Youth Administrator and the County Administrator.

 

The Commissioners approved and signed the 2008-2009 provider contracts for services provided to Children and Youth.  The contracts reflect a zero percent increase with the exceptions of programs funded completely by Medical Assistance or new programs which did not exist last year. 

 

The Commissioners approved and signed a Certification of County Funds for 2009 Program Year in the amount of $424,329.00 for the period of January 1, 2009 to December 31, 2010.  The purpose of providing the county matching funds is for the purchasing of agricultural conservation easements. 

 

Andrew Marhevsky resigned as a member of the Agricultural Land Preservation Board.  

 

The Commissioners adopted a proclamation to recognize Gene Kreitzer who will become President of the Pennsylvania Builders Association.   Mr. Kreitzer, the owner of Gene Kreitzer Construction, and member of the Lebanon County Builders Association will receive this honor during the Pennsylvania Builders Association’s installation Banquet in Hotel Hershey, Hershey, Pennsylvania.

 

Commissioner Litz revisited the concept of opening each Commissioners’ meeting with prayer and she stated her reasons why she believes a variation of prayer should be given.  A discussion followed.

 

Rev. Timothy Anderman, Pastor of Trinity United Methodist Church, Lickdale, stated his reasons as to why he believes it would be advisable to conduct prayer before each Commissioners’ meeting.

 

Martin Barondick resident of Ebenezer and self-proclaimed atheist, stated his reasons as to why Commissioners’ meetings should not open with prayer.

 

Jonathan Sonnen, resident in the City of Lebanon, asked questions of Mr. Barondick and asked about a moment of silence instead of prayer.

 

It was moved by Comm. Litz to open each Commissioner meeting with prayer.  Motion died for the lack of a second.

Thursday, February 12, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.  Stohler presiding.

 

The meeting opened with the Pledge to the Flag.

 

The Commissioners approved the minutes the previous meeting.

 

Commissioner Stohler stated that the County does indeed maintain an official record in the form of meeting minutes.  The official minutes are stored in the County Commissioners Office and a summary of the minutes is available on the County’s website.

 

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report.

The Commissioners moved to accept the Treasurer’s report with expenditures for $2,646,083.37. 

 

This week’s net payroll is in the amount of $1,015,249.96.

 

Andrew Cohen, President and Founder of Rock Properties, Newark, NJ 07102, met with the Commissioners to present a property status report and information on Weavertown Terrace (formerly Spruce Park), 500 Weavertown Road, North Lebanon, PA.  Mr. Cohen stated that Rock Properties, an Associates 500, L.L.C. Pennsylvania limited liability company acquired the 153 townhome property on March 29, 2007 at a purchase price of $6,162,500.  Rock Properties made $1.5 million in improvements and established a new culture of residential peace for the community.   Mr. Cohen also stated that he may return at a later date to ask the Commissioners for their support in Weavertown Terrace quest to obtain state and federal money to finish their program as an affordable workforce housing complex.

Paul Vranesic and Dennis Firestone were appointed as public official representatives on the Community Action Partnership (CAP) Advisory Board. 

 

Adam Hain, Jr., was appointed to fill an unexpired term on the Lebanon County Agricultural Land Preservation Board to end January 31, 2011.  

 

Dennis Wampler was appointed as a member on the Lebanon County Agricultural Land Preservation Board with a term to end January 31, 2012. 

 

The Commissioners accepted the resignation of Robin Stanley, Digna Rivera, Margaret Kreiser and Carol Checket as members of the Lebanon County Commission for Women. 

 

The Commissioners acknowledged the end of term for Barbara Charles and Diane Stott as members of the Lebanon County Commission for Women. 

 

Anita Fuhrman, Ashley Stoltz, Emily Guilliams, Kathy Kulbitsky, Maria Dissinger and Stephanie Shirker as members of the Lebanon County Commission for Women. 

 

On motion duly seconded, this meeting adjourned.

  

Wednesday, February 18, 2009   10:30 a.m. 

The regular meeting of the County Commissioners was held today at Cedar Haven, all members presiding.  Comm. Stohler presiding.

 

The Commissioners asked for public comment and no comments were heard.

Edward Schlegel, Administrator of Cedar Haven, met with the Commissioners to discuss the business matters of Cedar Haven.

 

The census for the facility is 95% of capacity.

 

The sprinkler system is 100% complete and a certificate from the Pennsylvania Department of Labor and Industry is forthcoming.

 

The following individuals were reappointed members of the Lebanon County Mental Health/Mental Retardation Advisory Board for a three-year term:

Charlotte Tumilty    Pam Thierolf

 

The Commissioners entered into a three-year contract with Keefe Commissary Network to provide commissary services to inmates at the Lebanon County Correctional Facility.

At 12:00 noon, the Commissioners met with other members of the Prison Board to conduct their monthly meeting.  

 

Thursday, February 19, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today.  Comm. Litz absent as she is in attendance at a State Agricultural Preservation Board meeting.   Stohler presiding.

 

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report.

The Commissioners moved to accept the Treasurer’s report with expenditures for $1,486,943.88.

 

Linnea Miller, resident of South Annville Township, met with the Commissioners to give a presentation and to submit a petition on the polling place location (Fontana v Zion Church) for South Annville Township.  Mrs. Miller asked the Commissioners to reconsider changing the polling place location back to Fontana specifically to Fontana Chapel.

 

 Chief of Police Benjamin Sutcliffe of South Annville, presented a traffic study of the polling location at Zion Evangelical Congregational Church during the November, 2008 General Election.  

 

The following individuals of South Annville Township stated their reasons as to why they recommend that the polling place location should be changed back to Fontana:

Stephanie Harmon, Watershed Coordinator in the Lebanon County Conservation District, met with the Commissioners to announce the Rain Barrel Workshop to be held on March 21st and April 6th at the District.

 

The Commissioners approved and signed, the Continuation Subgrant Award from the Pennsylvania Commission on Crime and Delinquency in the amount of $90,420.00 for the period of July 1, 2009 to June 30, 2012.  This grant will be used by the Adult Probation Department for the Electronic Monitoring program in Lebanon County.    This project includes 3 identified Probation Officers who supervise or assist in the supervision of Offenders who have been placed on Electronic Monitoring.   These Offenders are place on Electronic Monitoring either by the Court as a condition of sentencing or by the Probation Department as a disciplinary action. 

 

The Commissioners approved and sign the Pennsylvania Commission on Crime and Delinquency, the 2009 Intermediate Punishment Plan (IPP) Update.  This update addresses the “overcrowding” in the Lebanon County Correctional Facility with the enhanced Electronic Monitoring Program and other IP Programs that include the following:  

 

1.      Community Service Program

2.      Drug & Alcohol Treatment-based Restrictive Intermediate Punishment Program

3.      Electronic Monitoring

4.      D.U.I. Court Program

  

The Commissioeners approved to allocate additional funding toward the Growing Greener Project for spring reservoir repairs in Fountain Park, Schaefferstown, PA.   In addition to the original grant of $4,700, the County is providing an additional $36,500 for a total of up to $41,200 for the project.

At 1:30 p.m. the Commissioners sat as the County Board of Assessment.

 
Thursday, February 26, 2009   9:30 a.m. 

The regular meeting of the County Commissioners was held today, all members present.   Stohler presiding.

 

Sallie Neuin, Lebanon County Treasurer, presented the weekly Treasurer’s report with expenditures in the amount of $2,257,500.91. 

This week’s net payroll is in the amount of $1,042,911.54.

 

The Commissioners entered into a Merchant Capture Agreement with First National Bank of Fredericksburg and Lebanon County Commissioners for the Bank to provide certain electronic capture services (“Remote Deposit Services” or “RDS”) to Lebanon County. 

 

The Commissioners entered into and sign the Section 108 Loan Guarantee Cooperation Agreement between the Commonwealth of Pennsylvania, acting by and through the Department of Community and Economic Development and the Counties of Blair, Butler, Cambria, Lackawanna, Lebanon and Schuylkill, Pennsylvania and Boscov’s Department Stores, LLC.  This Agreement outlines the roles and responsibilities of the parties in obtaining, using and administering Federal Section 108 Loan Guarantee Funds to Boscov’s. Lebanon County share for this loan is $5,833,333 for a twenty (20) year period.  

 

Neva Luttman was reappointed to serve another term on the Lebanon County Housing and Redevelopment Authority which will end February 9, 2014.  

 

The Commissioners approved and signed the following Resolution for the Next Generation Farm Loan on behalf of the Lebanon Valley Economic Development Corporation:  

 

                              RESOLUTION OF APPROVAL NO. 2-26-09

                                             COUNTY OF LEBANON

                                            FUNDING THROUGH THE

                              NEXT GENERATION FRAM LOAN PROGRAM

 

NAME:  Marlin and Trisha Sensenig                                                   AMOUNT:  $450.000

 

WHEREAS:  The Jackson Township Industrial Development Authority has held a public hearing on the above-referenced application/project in the total amount of $450,00000 for the Next Generation Farm Loan in accordance with the requirements of the Tax Equity and Fiscal Responsibility Act of 1982, as amended;

 

WHEREAS:  The Jackson Township Industrial Development Authority has determined that the application/project conforms to the public purpose, eligibility and financial responsibility requirements of the Pennsylvania Economic Development Financing Law, and approved the above application/project at a publicly advertised meeting; and

 

WHEREAS: The project details are set forth in the public notice announcement attached hereto.

 

NOW, THEREFORE, BE IT RESOLVED:  We, the Commissioners of the  County of Lebanon hereby approve the revenue obligation or tax exempt issue as referenced above; and

 

BE IT FURTHER RESOLVED that the approval granted hereby shall not, in any way, pledge or obligate the credit or taxing power of the County, nor shall the County be liable for the payment of the principal of, or interests, on, any obligations issued by the Authority.

 

This Resolution is effective upon adoption.

The Commissioners approved and signed the Lebanon County Hazardous Materials Emergency Response Preparedness Assessment Update for Calendar Year 2007.  The County maintains an Act 165 Certified Team and operates as part of the South Central Taskforce. 

 

The Commissioners approved and signed the West Nile Virus (WNV) grant application for the January 1, 2009 through December 31, 2009.  The grant award will be $67,210.50 pending State approval. 

 

The Commissioners approved and signed the following proclamation for The Arc of Dauphin & Lebanon Counties to proclaim March 2009 as “NATIONAL INTELLECTUAL DISABILITIES AWARENESS MONTH” in the County of Lebanon.
